Sellers Terms And Conditions

Closiist is a marketplace designed to connect creative local producers (i.e. you), to new customers locally or even beyond. We believe that local production is the future of retail.


In order to make your experience as a seller the best possible, please read these conditions, which detail your rights, but also what we (Closiist) expect from you.

This policy is a part of our Terms of service. By opening a store with us (Closiist), you agree to those Terms and Conditions.

 

1. What Can be Sold on Closiist

Closiist is a marketplace whose mission is to promote local production. Everything that you sell on the marketplace has to be homemade.

By accepting these conditions, you agree to obtain all licenses and/or authorizations necessary for the marketing of your products in the state, county, city where your products are manufactured and sold. Closiist cannot be held responsible in the event that you do not respect these conditions.

Homemade products are items that are made and/or designed by you, the seller.

By selling homemade items, you agree that:

  1. All handmade items are made or designed by you. If you work with a production partner, you must disclose that production partner in your relevant listings.
  2. You accurately describe every person involved in the making of an item in your shop in your About section.
  3. You are using your own photographs—not stock photos, artistic renderings, or photos used by other sellers or sites.

If you are selling personalized or made-to-order items you agree that:

  1. All listings are available for purchase at a set price.
  2. If you are using photographs of previous work with options for customization (like color choices) included in the listing, you mus specify that those pictures are shown as examples

Your are encourage to be transparent about how your products were made and where your materials come from. You can disclose whether your products have specific attributes.

 

2. What Can't be Sold on Closiist

Even if they are homemade, some items can't be sold on the marketplace.

  1. Alcohol, Tobacco, Drugs, and Medical Drugs
  2. Human remains
  3. Dangerous Items: Hazardous Materials, Recalled Items, and Weapons
  4. Hate Items: Items that Promote, Support, or Glorify Hatred
  5. Illegal Items, Items Promoting Illegal Activity, and Highly Regulated Items
  6. Internationally Regulated Items
  7. Pornography and Mature Content
  8. Violent Items: Items that Promote, Support, or Glorify Violence

Reselling is not permitted. Reselling is define as selling products not made by you.

Keep in mind that customers may flag listings that appear to violate our policies. We may remove any listings that violate our policies. Closiist may also suspend or terminate your account for any violations. You’ll still be on the hook to pay any outstanding fees on your Closiist statement. 3. Transparency

Closiist value transparency. Transparency means that you honestly and accurately represent yourself, your items, and your business.

By selling on Closiist, you agree that you will:

  1. Provide honest, accurate information in your Seller Description
  2. Honor your Seller Policy
  3. Accurately represent your items in listings and listing photos.
  4. Respect the intellectual property of others. If you feel someone has violated your intellectual property rights, you can report it to Closiist.
  5. Not engage in fee avoidance.
  6. Not promoting or directing to your own store, in your Closiist Store description, product description, pictures and any material use to advertise your products on our store. Such behavior might lead to the suspension of your product or your account.
  7. Not create duplicate shops or take any other action (such as manipulating clicks, carts or sales) for the purpose of manipulating search or circumventing Closiist's policies.
  8. Not coordinate pricing with other sellers.
  9. Harassment or message to support or glorify hatred or otherwise are strictly prohibited and Closiist takes such act seriously. They may lead to the termination of your account. Closiist takes such act seriously

 

4. Privacy and Protecting Personal Information

You are responsible for protecting customers’ personal information you receive or process, and you must comply with all relevant legal requirements. This includes applicable data protection and privacy laws that govern the ways in which you can use Closiist user information. These laws may require that you post and comply with your own privacy policy, which must be accessible to the users of Closiist with whom you interact. Your privacy policy must be compatible with this policy and our Terms of Use.

You are responsible for protecting user personal information you receive or process and complying with all relevant legal requirements when you use the Services. This includes applicable data protection and privacy laws that govern the ways in which you can use a user’s information. Also, if you disclose personal information without the buyer’s proper consent, you are responsible for that unauthorized disclosure. This includes, for example, disclosures you make or unintentional data breaches. For example, you may receive a buyer’s email address or other information as a result of entering into a transaction with that buyer. This information may only be used for Closiist-related communications or for Closiist-facilitated transactions. You may not use this information for unsolicited commercial messages or unauthorized transactions. Without the buyer’s consent, and subject to other applicable Closiist policies and laws, you may not add any Closiist member to your email or physical mailing list, use that buyer’s identity for marketing, or obtain or retain any payment information. Please bear in mind that you're responsible for knowing the standard of consent required in any given instance. If Closiist and you are found to be joint data controllers of personal information, and if Closiist is sued, fined, or otherwise incurs expenses because of something that you did in your capacity as a joint data controller of buyer personal information, you agree to indemnify Closiist for the expenses it occurs in connection with your processing of buyer personal information.

5. Uploading and Writing Content

As a member of Closiist, you have the opportunity to create and upload a variety of content, like listings, Messages, text, photos, and videos. In order to keep our community safe and respectful, you agree that you will not upload content that is:

  1. Abusive, threatening, defamatory, harassing;
  2. Obscene or vulgar;
  3. In violation of someone else’s privacy or intellectual property rights; or
  4. False, deceptive, or misleading.

 

6. Our Review System

Reviews are a great way for you to build a reputation on Closiist. Buyers can leave a review after their purchase, including a one to five star rating.

On the rare occasion you receive an unfavorable review, Closiist may assist you in the resolution of the issue. Always keep in mind that a proactive resolution is the best way to avoid a bad review. If a customer raise a ticket regarding one of your order, a Closiist representative will contact you to see how the case may be handle.

 

7. A High Level of Customer Service

Closiist expect its sellers to provide a high level of customer service. By selling on Closiist, you agree to:

  1. Follow your shipping and processing times. Your are obligated to ship an item or otherwise complete a transaction with a buyer in a prompt manner, unless there is an exceptional circumstance. Please be aware that legal requirements for shipping times vary by country. Read more in our Shipping Policy.
  2. Respond to Messages in a timely manner.
  3. Honor your shop policies.
  4. Resolve disagreements or disputes with the buyer. In the unlikely event that you can’t reach a resolution, our team can help you and arbitrate the case
  5. If you are unable to complete an order, you must cancel the order according to our Refund Policy.

As a seller, you must provide great customer service and maintain trust with your buyers.

 

8. Responding to Requests for Cancellations, Returns, and Exchanges

Please be aware that in addition to this policy, each country has its own laws surrounding shipping, cancellations, returns, and exchanges. Please familiarize yourself with the laws of your own country and those of your buyers’ countries.

If you are unable to complete a transaction, you must cancel the order. The buyer will then be refunded. All cancellations, returns and exchanges are subject to our Cancellation Policy.

We encourage both parties to work together to come to an amicable solution.

If Closiist has reason to believe you, Your Content, or Your use of the Services violate our Terms, including this Seller Policy, we may deactivate Your Content or suspend or terminate your account (and any accounts we determines is related to your account) and your access to the Services.

Generally, Closiist will notify you that Your Content or account has been suspended or terminated, unless you’ve repeatedly violated our Terms or we have legal or regulatory reasons preventing us from notifying you.

 

9. Sales Tax collection Statement

Closiist Corporation is a registered New York State sales tax vendor and will collect sales tax on all taxable sales of tangible personal property that it facilitates for delivery to a New York State address.

This statement above, replaces the issuance of a form ST-150 to any Closiist marketplace seller. If you have questions regarding this statement, feel free to contact the sellers support team by email
